Mississippi DUI Law & What You're Up Against
In Mississippi, the legal blood alcohol concentration (BAC) limit is 0.08% for drivers 21 and over, 0.04% for commercial vehicle operators, and 0.02% for drivers under 21. Critically, you can be charged with DUI in Mississippi even if your BAC is below 0.08% if an officer believes you are impaired by alcohol, prescription drugs, or any other substance.
First offense: fine up to $1,000, up to 48 hours in jail (may be served through community service), 90-day license suspension, and mandatory completion of the Mississippi Alcohol Safety Education Program (MASEP).
Second offense within 5 years: fine up to $1,500, 5 days to 6 months in jail with a mandatory minimum of 5 days, 2-year license suspension, and mandatory ignition interlock device.
Third offense within 5 years: felony — fine up to $5,000, 1 to 5 years in state prison, 5-year license suspension. Felony DUI causing injury or death carries significantly harsher penalties including substantial prison time.
By driving on Mississippi roads, you have implicitly agreed to submit to chemical testing if lawfully arrested for DUI. Refusing the breathalyzer triggers an automatic 90-day license suspension — separate from any criminal conviction — and the refusal itself can be used as evidence against you in court.
